What The Jury Did Not Hear
He successfully defended himself in a hearing before Administrative Law Judge Steven Teate, where Agents representing the Department of Community Health testified under oath that Dr. Malloy had done nothing wrong in the course of his office billing procedures. Judge Teate found Tyrone Malloy Not Guilty of Medicaid fraud and the decision was never challenged.

Evidence Which Would Have Exonerated Dr. Tyrone Malloy - The Jury Did Not Hear It Or See It

Dr. Tyrone Malloy is NOT a criminal. He Is A Victim

In March 2010, the GA Department of Community Health notified me that the Program Integrity Unit had conducted a comprehensive utilization review of services billed and paid for by the Medicaid program. The premise being that the practice at Old National GYN had committed a fraud by billing Medicaid for abortion-related services. My Medicaid number was withheld and I received no payments due to their investigation that alleged that I had committed fraud.

I filed an Appeal with the Office of State Administrative hearings. My argument was that under the Family Planning Services Guidelines per the Medicaid Policies, confirmation of pregnancy, which entails lab work, and a sonogram are permitted and reimbursed. We have a patient information form which DCH has approved that specifically states that Medicaid does NOT pay for abortions, and if she desires to terminate the pregnancy whether with our facility or somewhere else, she will be totally responsible for the costs.

Anti-abortion radicals and those that nurtured the conspiracy towards Dr. Malloy, sought to destroy him because he performed abortions.

Judge Cynthia Becker suppressed evidence which would have exonerated Dr. Tyone Malloy. Witnesseses from Medicaid were not allowed to testify on Dr. Malloy's behalf before the jury.

The administrative hearing, where Judge Teate presided, said that Dr. Malloy did nothing wrong. He followed protocol. Judge Cynthia Becker did not allow the transcript of the Administrative Hearing to be introduced before the jury.

A marked up highlighted Medicaid book was left in the Jury room by the attorneys for the prosecution. Judge Becker allowed it to stay in the room.

This was a medical coding issue. He was by found not quilty by Judge Teate.

An ultra sound of a fetus in uterus was passed around for the jury to see. Judge Cynthia Becker allowed it over many objections by the defense attorneys. This trial was a witch hunt by radical anti-abortionist, who were in positions of power.
